Terms and Conditions of Service

1. Introduction

  • By engaging our services, you (the "Client") agree to be bound by these Terms and Conditions. These terms apply to all services provided by Construction Assessments and Surveys Ltd.  (the "Company"),

2. Services

  • The Company provides energy assessment services, energy performance advice, and related consultancy for residential and commercial properties.

  • The fee quoted is for a single run of SAP calculations, with a single set of iterations following Client comments. If further changes are made to the information provided once the calculations have been undertaken, or a second re‐run of the calculations is required to inform further options for building performance, then this will be subject to a separate quotation, approval and instruction.

  • Your assessment will be undertaken by a qualified On Construction Domestic Energy Assessor with (OCDEA) Accreditation

  • All assessments will be checked by the lodgement accreditation scheme with Elmhurst Energy, 16 St Johns Business Park, Lutterworth, LE17 4HB

3. Appointment and Fees

  • The Client agrees to pay the agreed-upon fee for the services provided.

  • A quotation outlining the scope of work and associated costs will be provided prior to any work commencing.

  • The Company reserves the right to revise fees in the event of any significant changes to the scope of work or unforeseen circumstances.

  • All reports will be issued with a draft watermark and invoice, with credit terms of payment within 14 days of the invoice date. Once payment has been received in full, the final report will be issued without draft watermark. Local authorities or approved inspectors will not accept a draft report for a Building Control application. Reports and their contents remain the property of Construction Assessments and Surveys Ltd. until payments for related invoices are settled in full.

4. Client Responsibilities

The Client, or their appointed representative is responsible for:

  • Providing accurate, complete, and up-to-date property details for the assessment. This may include but is not limited to, drawings, specifications, manufacturers details and other property-specific data. This is regulated by Department for Levelling Up, Housing and Communities (DLUHC) in England and Wales and checked by the lodgement Accreditation Scheme (Elmhurst Energy)

  • Providing a fully completed and signed As Built checklist in order to release the EPC.

  • Providing information to agreed timescales and format.

  • Ensuring all relevant information is provided to enable the Company to complete the energy assessment efficiently.

  • Any costs related to obtaining or verifying this information.

5. Delivery of Reports

  • The Company will aim to deliver assessments and any associated recommendations within the agreed timeframe.

  • Delivery times may vary based on the complexity of the property or other external factors, but the Company will notify the Client in case of significant delays.

6. Cancellation and Rescheduling

  • The Client may cancel or reschedule the service with at least 24 hours’ notice.

  • Cancellations or rescheduling within 24 hours may incur a cancellation fee of (£) to cover administrative costs.

  • If the required information is not provided by the agreed deadline, the Company may charge an additional fee for further time spent gathering or clarifying details.

7. Liability

  • The Company will perform services with reasonable skill and care in line with industry standards.

  • The Company’s liability is limited to the amount paid for the services provided.

  • The Company is not liable for any indirect, consequential, or punitive damages arising from the use of the energy assessment reports.

8. Confidentiality

  • The Company will treat all information provided by the Client as confidential and will only use it to deliver the agreed-upon services. Client information will not be shared with third parties without prior consent, unless required by law.

  • The company will retain key information during an assessment for a period of no less than 15 years for evidence and auditing purposes.

9. Ownership of Reports

  • The Client will own the final assessment reports once payment has been made in full.

  • The Company retains the right to use reports for internal purposes or as part of its professional portfolio, unless otherwise agreed.

10. Payment Terms

  • Payment for services is due (14) days after the invoice date, unless otherwise agreed.

  • Late payments will incur interest at a rate equal to the Bank of England base rate plus 1% per day, calculated from the due date until the outstanding amount is paid in full.

  • If payment remains overdue by more than 30 days, the Company reserves the right to suspend or terminate services until payment is received.

11. Governing Law

  • These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

12. Amendments

  • The Company reserves the right to update or amend these Terms and Conditions at any time. Clients will be notified of any significant changes.
